How the Credit System Works

There are three main credit bureaus that maintain a credit file that contains personal information about you and your credit history of borrowing and repaying money. You may have heard of these three for-profit companies before: Equifax, TransUnion, and Experian. Every time you take out a new loan or miss a payment, they are making a note in their credit file. Any time you apply for a new loan, another company, the Fair Issac Corporation (FICO), takes those three files and comes up with your credit scores based on their own special formula.

How We Got Bad Credit

Like many other Americans, when the economy tanked my husband's employer let go of half of its employees, including my husband. We were able to keep up on the bills with his unemployment check and my part time job but, eventually the checks ran out and the monthly payments proved to be too much.

To save our house, we ended up filing bankruptcy. In hindsight, it may not have been the best decision, but we did what we had to do to keep a roof over my family. The bankruptcy relieved us of our debt, but the damage to our credit was done.

The Fair Credit Reporting Act

Credit repair is made possible by the Fair Credit Reporting Act (FCRA) originally passed by the FTC in 1970. Several amendments have been made to it since then.

The FCRA allows consumers to dispute any items on their credit report that are believed to be inaccurate or questionable. The credit bureau must then do an investigation within 30 days. If they cannot prove the item belongs on your credit report, it must be deleted.
